【禁聞】谷聘京大狀 專家:或逃死刑但非主角

【新唐人2012年6月12日訊】前重慶市委書記薄熙來的妻子谷開來,涉嫌殺死英國商人海伍德一案的審訊安排,日前漸露眉目。日前有消息指稱,谷開來的家人已經聘請精通貪腐官司的北京資深律師沈志耕擔任辯護律師。而專家分析,谷開來可能不會被判死刑。但她並非王薄事件的主角。

6月10號,《路透社》引述兩名不願意透露姓名人士的消息透露,谷開來已聘請「北京縱橫律師事務所」合夥人沈志耕為辯護律師。沈志耕曾在公安部前副部長「李紀周受賄案」中辯護。

《路透社》週日致電沈志耕查詢,他既沒有承認也沒有否認受聘消息。他說:還不確定,還沒與谷開來見面。《路透社》要求他進一步說明自己可能擔任的角色,沈志耕回答:司法部門不允許談論這些事,現不允許與媒體聯繫。

「中國政法大學」客座教授王友金向香港《明報》表示,沈志耕應該是司法機關指派給谷開來的,但要幫谷脫罪很困難,因為如果當局要控告谷開來,說明已經掌握足夠證據了。

中國憲政學者、獨立候選人陳永苗認為,谷開來可能不會被判死刑,因為已經有一位司機來當替罪羊。

陳永苗:「我覺得不管谷開來罪惡滔天,她都不會被判死刑,已經有人頂死罪了,就是她的司機。她的律師不過是個花瓶,是個白手套,將來如果(對)她的決定,谷開來是判死緩的話,那麼他會把功勞歸於律師沈志耕。(但)我覺得絕對不是沈志耕能行的。」

報導指出,中國法律給予警察阻止疑犯與律師見面的權力,尤其是疑犯未被正式起訴之前,若沈志耕確實擔任辯護律師,谷案開審時他將成為中國近年最受矚目案件的焦點之一。

時事評論員、中國問題專家張傑連認為,谷案並不是王薄事件的主要線索,而只是帶出來的一個事件。

張傑連:「進一步為審理周永康做準備,我覺得這個才是真正的核心關鍵。現在薄熙來不管怎麼樣、還有谷開來已經都成為階下囚了,他判死刑也好、不判死刑也好,他們的政治影響力和政治生命基本就完結了。」

海伍德去年11月倒斃在重慶一間酒店內,中共官方今年4月宣佈谷開來和薄家勤務人員張曉軍「涉嫌故意殺人罪」,已移送司法機關。有傳聞指稱,案件將在中共高層下個月「北戴河會議」前宣判。

香港《南華早報》日前則引述北京消息說,谷開來可能因懷疑「精神失常」而獲較輕判刑,張曉軍可能判死刑。

張傑連認為,谷開來惡事做多了,如果精神方面出現甚麼問題也是情理之中的事情。目前中共有意放風,真真假假的消息都摻在其中。

張傑連:「從谷開來帶出薄熙來,這個公開審理做實的話,能徹底打擊薄熙來和周永康的聯盟。這個是胡溫利用民意的一種方法,而且是名正言順,出師有名的,在這一步上我覺得應該是會走公開審理這條路。」

另外,張傑連特別指出,無論政法委周永康最後的下場是甚麼,但是其中很重要的一環,就是,周永康以及江系血債幫的權力鏈條己經斷裂。

張傑連:「這個鏈條一斷,事實上他驅動後面所有要做的很多事情的動力系統就徹底的垮掉了。所以對待周永康其實是一個時間問題,它不是一個將來還有甚麼變數,或者是還有甚麼機會的問題,事實上已經徹底的沒有機會了。只不過是胡溫要有一個過程。」

另外,台灣《聯合報》日前引述大陸官方消息指稱,薄熙來共涉11宗命案,海伍德案只是其中之一,北京會選擇在適當時機「一一曝光」。

Gu Kailai Hired Beijing Lawyer;
Experts say: She Might Escape Death Penalty,
but Is not Main Protagonist

Gu Kailai, wife of former Chongqing Party Secretary Bo Xilai,
was suspect murderer of British businessmen Neil Heywood.
Recent news said that Gu’s family have hired senior lawyer
Shen Zhigeng, who is famous for handling corruption cases.
Experts said Gu will probably not be sentenced to death,
but neither is she the main protagonist of the case.

June 10, Reuters quoted from two anonymous informants that
Gu Kailai has hired Shen Zhigeng to be her defense lawyer.
Shen, partner at Beijing Zong Heng Law Firm, once represented
Li Jizhou, former Vice Minister of National Public Security, in his case of bribery.

Sunday, Reuters approached Shen Zhigeng by phone,
but Shen refused to make any comment.
He said it was still unconfirmed and he hadn’t met Gu Kailai.

Upon further inquiry about his potential role in the case,
Shen answered that judiciary departments forbade him to comment or talk with media.

Wang Youjin, guest professor at China University of Political
Science and Law, said to Hong Kong newspaper Ming Pao,
that Shen Zhigeng must have been assigned
to Gu by the judiciary.
However, he said, it would be hard for Gu to be acquitted
since the authorities must have sufficient evidence against her.

Chen Yongmiao, scholar of constitutional politics
and independent candidate,
said Gu might not be sentenced to death because
she has a driver to be her scapegoat.

Chen Yongmiao: “Whatever her crime,
I think Gu will not be sentenced to death,
because her driver has shouldered the responsibility for her.

Her lawyer only plays the role of a vase.
If Gu is finally sentenced to death with reprieve, Shen Zhigeng will be credited.
But I believe Shen is unable to do anything himself.”

Reports said Chinese law allows the police to deny meetings
between suspect and lawyer, especially before formal prosecution.
If Shen Zhigeng really serves as Gu’s defense lawyer, he will
become the focus in a case of the widest attention in recent years.

Critic and China issue expert Zhang Jielian believes that Gu is
only a triggering event of the Wang-Bo case, not the main theme.

Zhang Jielian: “I believe the key point is to further prepare
for prosecuting Zhou Yongkang. Both Gu Kailai and Bo Xilai have become prisoners.
Whether sentenced to death or not, their political influence and
political life have come to an end.”

Last Nov., Neil Heywood died in a hotel in Chongqing.

This April, Chinese authorities announced Gu Kailai and
Zhang Xiaojun, service personnel to the Bo family, are suspects of murder.
Rumors said their punishment will be announced at
Beidaihe meeting of Chinese leaders next month.

Hong Kong's South China Morning Post recently quoted
Beijing sources that
Gu might be sentenced lightly due to “mental disorder,"
while Zhang Xiaojun may be sentenced to death.

Zhang Jielian said it would be reasonable that
Gu had mental problems given all the crimes she committed.
Now CCP intentionally released all the news,
both true and false.

Zhang Jielian: “If Hu and Wen attack Bo Xilai
with Gu’s public prosecution,
they will destroy the alliance between Bo and Zhou Yongkang.

This will not only gain support of public opinion,
but also have legal and moral justification.
I personally believe public prosecution is the best choice.”

Zhang Jielian specially pointed out that regardless of
the fate of Zhou Yongkang,
the Jiang Zemin faction’s power chain has finally broken.

Zhang Jielian: “Once this chain is broken,
the entire power system from behind will totally collapse.
Zhou Yongkang’s fate is only a matter of time,
without any chance of change in his favor.
Zhou has actually completely lost his Chance of success.
Hu and Wen are merely waiting, allowing some time to have it processed.”

Taiwan's United Daily News quoted mainland officials,
Bo Xilai is involved in 11 murders, Heywoods case being just one of them.
Beijing will choose the appropriate time to announce them all.
