【禁闻】重庆悄悄返还个别“涉黑”资产

【新唐人2013年11月05日讯】重庆市在前市委书记薄熙来“打黑”期间,涉及的千亿元“涉黑”资产如何处置﹖重庆当局最近采取低调做法,悄悄的返还部分“黑老大”资产,不过,当事者各方还需要签订“保密协议”。本台记者采访了重庆一些“涉黑企业”的高管和律师,他们表示,并未收到当局返还“涉黑”资产的通知。事实上,在薄熙来倒台之后,那些被薄熙来打为“黑老大”的民营企业老板的资产,仍继续被重庆市法院和专案组拍卖,并收归国库。

据大陆媒体《中国经营报》报导,重庆当局早前陆续向部分受害民企退款,包括李俊的“俊峰集团”及“重庆希尔顿酒店”股东彭治民,但当局坚持当年“打黑判决”不改。

因“涉黑”,2011年5月被判处无期徒刑的彭治民,被捕前拥有八家公司、资产达70亿元。今年5月,重庆市高级人民法院裁定﹕没收彭治民持有的重庆“庆隆屋业发展有限公司”28.6%股权中的14.3%,上缴公库。

报导说,今年6月,重庆当局解除重庆“国地资产经营管理有限公司”托管重庆“庆隆屋业”、和“众诚物业”等八家公司的经营权及股权,从而这些公司的原有管理团队重新掌握了公司运营权。

但是,被打为重庆“黑老大”的马当,他的辩护律师刘洋对《新唐人》表示,最近并没有接到任何返还资产的通知。他认为,彭治民的情况可能只是个案,不代表重庆的政策有所改变。他说,在薄熙来倒台之后,重庆法院和专案组依然继续拍卖“涉黑”公司的资产,并收缴国库。

刘洋:“薄熙来当政的时候拍卖了两次。然后薄熙来出问题以后,拍卖了一次。前两次都流拍了,最后一次拍卖成功了。应该是在薄熙来出事以后那次成功了。当然这个拍卖以后的钱,据我所知还是划到重庆国库里面去了。”

重庆法院方面还向刘洋透露,上级要求把没收的“涉黑”资产统一交到法院进行拍卖,但是专案组迟迟不上交。

刘洋:“他们上面有个决定,把分散在各个机关执行的,各个地方的财产集中到法院,由第三中级法院一家主要进行执行,当然其他单位还要协调。可是这个通知下去以后,他们迟迟不交资产,特别是原来管理案件的专案组,迟迟不交资产。”

刘洋表示,如果“涉黑”的刑事案件本身不平反或改判,“涉黑”资产不可能归还。因此他们一直在申诉。

刘洋:“申诉案件很快的就被重庆高级法院驳回了。因为中央还没有新的一轮对这个案件的整体处理思路。我们感到申诉目前来说还是看不到希望。”

另外一名“黑老大”,重庆商人李俊,目前藏匿海外。李俊集团下属的“俊峰置业有限公司”法人罗皓告诉《新唐人》,2011年6月的时候,公司被没收两个亿,在后来的一年多时间,这笔钱陆陆续续归还了。但是还有一笔被没收的资金6680万没有归还。他们目前启动了行政赔偿和刑事赔偿两个诉讼,要求沙坪坝区法院归还,但是法院始终不做出回应。

重庆市俊峰置业有限公司法人罗皓:“当时在案发后,在法院还没有进行审理的时候,刚刚案发,专案组就把6680万给转走了。后来在去年9月份的时候,法院就出了一个裁定,裁定专案组这种做法是合法的。但是我们通过谘询律师,对整个事件进行评判,律师、法学专家都认为(法院)这个做法至少违背了两个原则。”

罗皓也透露,由于公司被监管期间,资金和公章被没收,造成大量历史遗留问题。企业不仅仅面临资金短缺,由于延迟交房,客户要求退房和索赔等问题,令企业目前举步维艰。

有律师认为,重庆当局不愿彻底平反“打黑判决”,未必是想肯定前任的薄熙来,而是“无法全额退款”。

Will Local Chongqing Government Return Confiscated Assets from Bo Xilai Campaign?

The local government in Chongqing are alleged to
have confiscated more than 100 billion yuan of assets.
This was during former Party Secretary
Bo Xilai's “hitting the gangsters” campaign.
It has been reported that the Chongqing authorities
are now quietly returning a part of these assets.
This is being done under a confidentiality
agreement, signed by the parties involved.
NTD reporters contacted some of the executives
and lawyers previously labeled as “gangsters”.
None of them have received a
notice for the return of their assets.
Since the downfall of Bo Xilai, the Chongqing Municipal
Court has continued to keep those confiscated assets.
In addition, the State treasury gets
to keep any earnings from auction.

According to China Business report, authorities
in Chongqing authorities have returned some
of the assets to previously charged businesses.

This includes assests to Li Jun, from the Junfeng Group,
and Peng Zhimin, shareholder of Chongqing Hilton Hotel.
However, the authorities are insisting that
the court's original verdict was correct.

Peng Zhimin was sentenced to life imprisonment in
May 2011 during Bo's “hit the gangster” campaign.
He was the owner of 8 companies
and had assets worth 7 billion yuan.
This May, Chongqing Municipal Higher People's Court ruled
to forfeit half of his stake at Qinglong Housing Development
Company, in which he owned 28.6% of the shares.

The operating and equity rights of 8 companies,
including Qinglong Housing, were transferred to
the National Assets Operation and Management.

It was reported that this June, Chongqing authorities released
the rights back to the original company's management teams.

Attorney Liu Yang was the defense lawyer of Ma Dang,
formerly labeled as one of the Chongqing 'top gangsters'.
In an interview with NTD, Liu indicated that he
has not received notice about returning any assets.

He believes Peng Zhimin's situation is just an isolated case.

After the fall of Bo Xilai, the court in Chongqing
has continued to auction confiscated property,
and the State treasury takes the profits earned.

Liu Yang: “It went through auction twice
during Bo Xilai's term. Both auctions fell.
After Bo's case went public, there was
another auction, which was successful.
As far as I know, the money went
directly to the Chongqing treasury.”

The Chongqing court told Liu Yang that the central
authorities demanded the auction of confiscated property.
However, a special task force delayed the process.

Liu Yang: “The higher levels decided to collect all properties
into the Third Intermediate Court, to execute the auction.
However, the task force for Ma Dang's
case has not yet returned anything.”

Liu Yang indicates that if the case itself is not
vindicated, and the verdict remains as it was,
there is no way to retrieve confiscated assets.

Therefore, they have been appealing the case.

Liu Yang: “The appeal was quickly
dismissed by the Chongqing High Court.
This is because the central authorities have
not reached a concensus on how to proceed.
We see no hope for our appeal at this point.”

Businessman Li Jun, who was also labeled in
Chongqing as a 'top gangster', is now hiding overseas.
Luo Hao, the legal representative for Li Jun's
group subsidiary Junfeng Properties, spoke to NTD.
200 million yuan was confiscated in June 2011.

This was gradually returned a year later.

However, another 66.8 million
yuan has not yet been returned.
They have initiated lawsuits for executive
compensation and criminal damages.
They are demanding Shapingba
district court to return the assets.
There has been no response yet from the court.

Luo Hao, Junfeng Properties legal representative:
“Prior to the hearing, a special task force had
removed 66.8 million yuan from the company.

Last September, the court ruled that
the actions of the task force were legal.
We consulted with lawyers and legal experts, and the
court's decision has violated at least two principles.”

Luo Hao also revealed that during the supervision,
both the funding and official seal were confiscated.
As a result, the company is facing funding
shortages, customer claims cases, and breaking
contracts due to delays in finishing construction.

The company is facing many difficulties.

There are also lawyers who believe there are reasons
why the Chongqing authorities are reluctant to vindicate
cases from Bo Xilai's “hitting the gangster” campaign.

It is not necessarily related to Bo Xilai, but
related to being unable to give full refunds.
