【禁闻】不动产登记 能反腐?能压房价?

【新唐人2014年08月18日讯】中共最近公布了《不动产登记暂行条例》草案,并向社会征求意见。中国大陆有人把它看成是“反腐利器”;还有人认为它能压低房价,等等。不过,海外学者对此却有不同的看法。请看报导。

8月15号,中共国务院法制办公室在其网站公布了《不动产登记暂行条例(征求意见稿)》,征求意见截止到9月15号。

这份条例规定,由国务院国土资源主管部门牵头,建立统一的“不动产登记资讯管理基础平台”,实现资讯即时共用。

不动产登记范围,包括集体土地所有权;房屋等建筑物、构筑物所有权;森林、林木所有权;耕地、林地、草地等土地承包经营权;建设用地使用权和宅基地使用权等。

北京《国情内参》期刊首席研究员巩胜利指出,不动产登记在中国大陆是多馀的。因为老百姓的不动产主要是房产。那么,不动产登记与房地产证是“换汤不换药”。如果原来的房地产证不取消,这种登记除了耗费国家大量的资源以外,没有实际意义。

北京《国情内参》期刊首席研究员巩胜利:“你既然出了个不动产登记,那你原来的房地产登记还要不要呢?我从去年就关注到,因为习李新政他把不动产作为他改革一个重要的方向。”

除了老百姓登记之外,官员当然也理应按照该条例,登记不动产,这样是否就能抑制各地“房爷”、“房姐”、“房叔”之类的贪腐官员呢?

大陆国家行政学院教授汪玉凯对《新京报》表示,“不动产统一登记平台”建立后,会对这些贪腐官员带来压力。

但实际上,仔细看新出台的《不动产登记暂行条例(征求意见稿)》,就可以发现,其中规定了不动产的“资讯公开程度”。

条例说,“权利人、利害关系人、有关国家机关可以依法查询、复制不动产登记资料,但不得将查询获得的资料用于其他目的﹔未经权利人同意,不得向社会或者他人泄露查询获得的相关资料。”

美国南卡罗莱纳大学艾肯商学院教授谢田:“这个登记草案看来,并不是真正公开的、透明的。老百姓还是不能看得到、公共媒体、舆论也不能看得到,也没法知道这些官员到底是有多少人是拥有几十栋、几百栋房地产。”

谢田教授指出,不动产登记在正常社会是一项好政策,非常利于舆论、民众监督官员,然而中共把它用歪了。

谢田:“在美国就是这样的,每一块土地我们都清清楚楚知道是谁拥有的,谁要负责要交房地产税,政府也知道谁在住在上面或谁在拥有上面,向谁收税。”

谢田表示,中共变了味的不动产登记制度,只能成为党内派系内斗、互相绞杀对方的证据。

美国《纵览中国》网刊发行人兼主编、普林斯顿大学中国学社执行主席陈奎德认为,习近平无法在高层官员中推广这项政策。

陈奎德对《美国之音》表示,虽然有传闻说,习近平限制自己姐姐出境,可是他不会真正触动其他高层官员,以及他们的亲属的敛财行为,不然整个政府就会垮台。

其实,中共早在2007年颁布的《物权法》中,就正式提出了“不动产统一登记制度”,去年3月国务院办公厅更是规定,要在2014年6月底前出台“不动产登记条例”。

但直到现在,这一政策出台还遥遥无期,也显示出党内各派的绞杀激烈。

除了抑制贪腐官员,大陆还有人期待这项政策能够降低房价。

巩胜利:“房地产涨势已经连续涨了改革开放的36年了,再继续涨下去,老天爷也知道是不可能的事情。”

谢田也表示,房价下降是必然趋势。如果不动产登记还依然不透明,它对房地产降价趋势不会有丝毫影响。

Will Real Estate Registration Resolve Corruption
And Cut Housing Prices?

CCP recently published a draft, "Provisional regulations on
real estate registration," and sought feedback on the provision.

Some refer to it as the anti-corruption weapon, while some
believe it can drive down housing prices.

But, overseas academics have different views.

On Aug. 15, the State Council Legislative Affairs Office
website announced the "Provisional regulations on real estate
registration" is seeking opinions by September 15.

The regulations are led by the land resources department
of the State Council.

It aims to establish a unified real estate registration
and management platform for real-time sharing of information.

The range of real estate registration includes collective land
ownership; houses and other buildings and structures;
forest, forest land; contract and management rights of farmland,
woodland, grassland, and etc; ownership of construction land
use rights and land use right and so on.

Chinese finance researcher Gong Shengli indicates that
real estate registration in China is superfluous.

People’s main real estate is the house.
Real estate registration is the same as housing registration.

Without canceling housing registration, another real estate
registration is only a waste of national resources.

Gong Shengli: "With a new real estate registration, will the
(old) housing registration be revoked?

I have noticed since last year that Xi and Li have intended
to go after real estate reform."

Following the regulations, officials should also register
their properties.

Will this provision restrict corrupt officials in real estate?

Professor Wang Yukai, China National School of Administration,
told Beijing News that unified real estate registration
will put pressure on corrupt officials.

But in fact, a close look at the "Provisional regulations" will
reveal the level of information openness on real estate.

It said, "The owner, interested parties, relevant national
authorities may lawfully query and duplicate the real estate
registration information, but the information can not be used
for other purposes.

Without the consent of the owner,
relevant information shall not be disclosed."

University of South Carolina Aiken School of Business
Professor Frank Xie: "This draft means it is not really public
or transparent. No one can see it, not the people nor the public
media.

People will never know how many properties the officials have."

Professor Frank Xie points out that in ordinary society,
real estate registration is a good policy and is very conducive
to supervision of officials. But the CCP has distorted its purpose.

Frank Xie: "We know clearly the land ownership and who is
responsible for property taxes in the United States.

The government also knows who owns what and
who to get the taxes from."

Frank Xie indicates that the CCP has manipulated the real
estate registration system and turned it into evidence
to attack its opponents.

China in Perspective publisher and editor, Chen Kuide, is also
the Executive Chairman of Princeton China Initiative.

He does not believe Xi Jinping will be able to promote
this policy to the senior officials.

Chen Kuide told Voice of America, even though Xi Jinping
has restricted his own sister leaving China, but he will not
touch other high officials or the money-making behavior
of their relatives.

Otherwise, he is risking the collapse of the entire regime.

In fact, the CCP proposed a unified real estate registration
system as early as 2007 when Property Law was promulgated.

Last March, the State Council also ruled to introduce
the Real Estate Registration Ordinance by the end of June.

But to this date, this ordinance is still yet to see.
It shows the intense struggling among factions within the party.

Other than targeting corrupt officials, there are also people
hoping the policy will bring down housing prices.

Gong Shengli: "The price of real estate has continued to rise
for the past 36 years since the reform and opening up.

Even gods know it’s impossible to continue this price rise."

Frank Xie also says that the decline in housing prices
is inevitable.

Even if real estate registration remains opaque,
it won’t stop the real estate price from going down.
