【新唐人2015年01月26日讯】美国非政府组织《人权观察》日前发表声明,警告中共的《反恐怖主义法》草案有严重缺陷,需要修改。声明警告,如果按照去年11月当局提出的相关草案,将导致中国法律允许践踏人权。
去年11月3号,中共公布了《反恐怖主义法(草案)》,并面向社会征求意见,截止日期是去年12月3号。不过,目前外界还不清楚在中国,有甚么人提出了甚么意见。
草案规定,建立国家反恐怖主义情报中心和跨部门情报信息运行机制,统筹情报信息工作,应对处置预案体系,并明确指挥长负责制和先期指挥权,反恐国际情报合作等。
中共媒体则报导,反恐怖主义斗争形势严峻复杂,暴力恐怖活动出现多发频发、网上网下互动等新趋势。制订反恐怖主义法,有利于在国际反恐怖主义合作中把握主动。

中国资深法学专家赵远明:“我觉得它这个反恐主义法律253有意把反恐和民族纠纷,或者是政见不同者这个都混为一起,以便以后它们好在执行法律的时候,任意对民众,或者对某些人进行逮捕、法办。”
中国资深法学专家赵远明分析,中共面临越来越严重的统治危机,因此它认为有必要制定一部法律,用来打压对中共政权造成威胁的各种力量,以维护它专制政权的稳固。
赵远明:“那么它就将一部法律制定出来之后,涵盖面越大越好,也就是我这个法律出来之后,管很大的一个范围,那么,你在这个范围之内有点异样的行为,或者异样的言论,我都可以根据这一个法律去管理你。”
过去一年,中国多地接连发生砍杀血案。去年6月份,中共宣称面临建政以来,最严重的恐怖主义威胁,于是把“反恐”防暴提升到最高级别。除了动员“全民反恐”外,还把“反恐怖小组”,升级为“国家反恐怖工作领导小组”,并宣布年内出台新的“反恐法”。
中国人权观察主席秦永敏认为,中国目前更严重的是国家恐怖主义,滥用公权力对无辜民众抓捕关押,强拆强征,甚至把人碾成肉饼。
中国人权观察主席秦永敏:“谁都知道在中国这样一元化统治国家,所有的打砸抢,穿着统一服装上街的都是它们(中共)的人,包括2012年所谓的‘反日游行’里头也是这样,那些上街的打砸抢的,损失了人家几亿美元的财富,也没有追究法律责任,那都是它们自己操纵的。”
秦永敏表示,中共对民众人权的践踏,以及对民间各个阶层的镇压和威慑,都是更令人发指的国家恐怖主义。
时政评论员汪北稷:“中共创办初期就是暴力恐怖主义起家的,它们所谓的南昌起义南方暴动,到之后的农村的暴动,到所谓的大跃进,都是暴力活动,那比现在更惨烈,它们向外国政府获得枪支获得培训,或者理论支持,对中国人农村城市里面去抢劫去暗杀,去占领根据地,组建地方的武装。”
时政评论员汪北稷表示,中共党史就是用人民鲜血写就的血淋淋的暴力史,包括89年六四屠杀,以及99年延续至今对法轮功的镇压,甚至活摘人体器官等,所以,中共最符合国家恐怖主义的称号。

Human Rights Watch: China's Draft Counterterrorism Law
a Recipe for Abuse
Human Rights Watch, a US NGO, warned that the Chinese
Communist regime should radically revise its proposed
legislation on counterterrorism.
The draft law, proposed in November 2014,
was criticized as a license to commit human rights abuses.
The draft law on counterterrorism was made public
for consultation on Nov. 3, 2014.
No specific comment has been made in the mainland.
The draft law would establish a new leading organ
on counterterrorism work and a national counterterrorism
intelligence center under the new leading organ
to centralize information between the relevant departments.
The new leading organ will co-ordinate the intelligence,
emergency response plan, and command day-to-day work
on counterterrorism nationwide.
State media hyped that anti-terrorism is a complicated
and grim struggle among the frequent violent and terrorist
activities both online and offline.
The counterterrorism law will help to take an active role
in counterterrorism in the international community.
Human Rights Watch warned of serious flaws in the draft law:
Terrorism is conflated with religious extremism.
The designation of terrorist organizations by the state
is devoid of due process protection.
The authority and powers of the new body in charge of
coordinating counterterrorism work are vague
and would expand the coercive and surveillance powers
of law enforcement agencies.
Senior legal expert Zhao Yuanming: "I think this
counterterrorism law intends to lump together
counterterrorism, ethnic conflicts and dissidents
to legitimate their wanton arrest and trial of the people."
Zhao Yuanming analyzes the ruling crisis of the Communist
regime has forced it to enact a law to suppress any force
of potential threat to its authoritarian rule.
Zhao Yuanming: "With a law of vague limits, means it covers
a great range, any deviant behavior or expression
can be subject to the regulation of the law."
Last year, multiple bloody attacks took place in China.
Last June, the CCP claimed the most serious terrorist threat
since its foundation and raised counterterrorist measures
to the highest level.
The entire population was mobilized in anti-terrorist
activities.
The work group against terrorism was upgraded
to a national leading organ on counterterrorism work,
and the new counterterrorism act is to be enacted
within a year.
President of Human Rights in China, Qin Yongmin, believes
state terrorism is the most serious in China,
where authority has been abused to arrest and imprison
innocent people,
to conduct forced demolition and land acquisition,
and even crush people with tanks.
Qin Yongmin: "Everyone knows that in a country of unified rule
such as China, all of the vandalism is done by their own people
who wear the same outfit.
For example, the so-called anti-Japan demonstration in 2012
included those who took to the streets and conducted
vandalism and caused damage worth of hundreds of millions
of dollars but were never held accountable.
These are manipulated by the Communist regime themselves."
Qin Yongmin indicates that the CCP tramples on human rights,
represses and restricts society at all levels
and is more heinous state terrorism.
Current affairs commentator Wang Beiji: "The CCP was
founded on violent terrorism,
including the so-called Nanchang Uprising,
riots in the countryside, the Great Leap Forward.
Those were even more tragic than it is now.
They received firearms and training and theoretical support
of foreign countries to rob and kill.
They also occupied bases and organized local armed forces."
Wang Beiji explains that CCP history is a history of violence
written with the blood of the people;
including the 1989 Tiananmen massacre, the persecution
of Falun Gong since 1999, and even live organ harvesting.
Therefore, State Terrorism is the most appropriate title
for the CCP.
