【新唐人2014年11月17日訊】11月15號,準備前往北京表達「真普選」訴求的三位香港學聯代表,被航空公司拒絕登機,並被告知:他們的回鄉證已被中共當局註銷。這一消息在國際社會引起關注。有大陸律師和香港立法會議員向本臺表示,中共這一舉動,本身就是違法的。外界則認為,這對當前北京提倡的所謂「依法治國」,可說是一個莫大的諷刺。
香港學聯祕書長周永康、常務祕書鍾耀華和常委羅冠聰,15號凌晨在網上預辦了登機手續,當天下午在機場的記者會上,周永康還表示,會將香港人追求民主的訴求帶到北京。
不過事情沒有像學生們想像的那麼簡單。當他們經過特別通道進入禁區後,還沒有經過安檢,就遭到機場人員截攔,被迫返回到航空公司櫃檯。航空公司的工作人員告訴他們,他們的回鄉證已經被註銷,不能登機。
北京律師:「突然宣佈回鄉證註銷,不允許登記,從法律上當然是違法的,既然是通過一定的程序發放的,註銷也要通過一定的程序,要有法證事由來支持你這個註銷的行為,並且也應該允許被註銷人有機會申訴、複議、訴訟或其他一系列的救濟。」
所謂「回鄉證」,也即港澳居民來往內地通行證,是指具有中國國籍的香港居民和澳門居民來往中國內地所用的證件,有效期分為3年和10年兩種。
香港立法會議員梁家傑:「當然是很大衝擊了法治,是權大於法的體現,這幾位同學拿的是有效的回鄉卡,你為甚麼可以突然註銷了?而且是通過航空公司的職員給他們知會的,這個是哪一門的法?是個很大的諷刺。」
中共當局通過註銷三位學生回鄉證的方式,來拒絕對話民意,在國際社會引起關注,消息一出來,立即被不少海外媒體列為頭條新聞。
一時間網上的各種嘲諷不斷翻新。民運人士周封鎖在推特上發問:「取消學聯回鄉證甚麼意思?香港獨立了嗎?」並說這是「匪共分裂中國!」
網友「量化環境」則說:香港人現在應該認真考慮,廢除回鄉證!既然是「一國」,就應該自由通行!通過公民不服從來實現自由通行,是真普選的第一步。
網路作家荊楚:「有一個講法說的非常精彩,說共產黨有兩百萬黨衛軍,有兩百萬看門狗警察,怎麼會怕三個學生跟他們去訴求呢?」
《亞洲新聞週刊》總監黃金秋:「應該是怕香港學生和香港市民代表的那種對民主的訴求,蔓延到內地。這個做法首先是違背習近平先生以憲治國、依法治國的理念的;第二點,對話總比對抗好,不管這三個學生的做法,政府容納還是不容納,人家到北京來談是有誠意的,應該給人家一個講話的機會。取消回鄉證在國際上影響不好。」

On Nov. 15, three representatives of the Hong Kong
Federation of Students (the Federation) who intended
to express the demand of true universal suffrage in
Beijing were not allowed to board a plane.
Their return home permits to China
were canceled by the authorities.
The news has caused concern in the
international community.
A Chinese lawyer and Hong Kong Legislative Council
Member told NTD that Beijing's move is illegal.
The"rule of law" acclaimed by Beijing is commented
on as an obvious irony.
Federation members Alex Chow, Eason Chung and Nathan
Law registered at the online check-in on Nov. 15.
In the press conference at the airport, Alex Chow said they
were bringing the demand for democracy to Beijing.
But it was not as easy as the students thought.
In the restricted area, they were told by airport staff before
the security checks that their permits had been revoked.
Unable to board their flight, the three were forced
to return to the airline counter.
Beijing lawyer Tang Jitian, "This sudden announcement
of permit cancellation is certainly illegal.
It was issued through a procedure, the cancellation should
follow some procedure as well.
It takes legal grounds to support the cancellation.
There ought to be procedures for appeal, reconsideration,
litigation and so on."
The so-called home return permit is also known as the
Mainland Travel Permit for Hong Kong and Macau Residents.
It is generally valid in two forms, for 3 years and 10 years,
respectively.

It was immediately headline news for many overseas media.
Online ridicule was constantly seen online after this.
Activist Zhou Fengsuo Tweeted, "What does cancelling the
home return permits of the Federation students mean?"
Other comments were, "Is Hong Kong independent?", and
"the CCP splits China."
Netizen "Quantitative Environment" wrote: Hong Kongers
should seriously consider abolishing the home return permit.
Since it is "one country", it should be free traveling!
Realizing free travel through civil disobedience
is the first step to true universal suffrage.
Internet writer Jing Chu, "There is a very exciting argument:
the CCP has a 2 million party protective squad and 2 million
gate keeper police, but is frightened by three students
and their demands?"
Asia's Newsweek director Huang Jinqiu, "I think they fear the
spread of democratic demand to mainland by the students.
This approach goes against Mr. Xi Jinping's idea of rule
of the Constitution and rule of law, to begin with.
Secondly, a dialogue is better than confrontation.
Whether to accept or to deny the approach of the three
students, their intention towards Beijing is sincere.
The opportunity should be granted.
Revoking the permits gives a bad impression
to the international community."

surprise over the cancellation of their home return permits.
He thinks this approach is equivalent to confiscate the
autonomy rights of Hong Kong.

and cowardice of the regime.
They can’t even tolerate the most peaceful expression.
Now it is clear to everyone, who holds a willing attitude
to solve issues and who does not."
Hong Kong legislator Sin Chung-kai told NTD that revocation
of permits to block Hong Kongers' return to China has been
seen in many times in the past.
Beijing lawyer Tang Jitian says that the home return permit
is itself very absurd.
It divides Hong Kong and China into two worlds.
However, the CCP has been used to trampling on the law,
restricting personal freedom through various documents.
Hong Kong Legislative Council Alan Leong wants to remind
