【禁闻】民间反腐遭寒潮 反贪学者遭拘捕

【新唐人2013年07月19日讯】中国公民维权的领军人物,北京宪政学者许志永,以反贪腐着称,倡议官员公开财产。他被中共当局软禁家中3个月后,日前当局以 “涉嫌聚众扰乱公共场所秩序罪”将他刑拘。反腐人士预感:“中国梦变恶梦”的寒潮已经来临。我们一起来看以下这则报导。

16号午夜12点左右,法学博士、北京邮电大学讲师许志永遭到刑事传唤,当局人员进入他的家中,抄走了三台电脑以及手机等物品。

拘留书上说:许志永因“涉嫌聚众扰乱公共场所秩序罪”被刑事拘留,现羁押在北京市第三看守所。

北京宪政学者许志永辩护律师刘卫国:“他们不让见,说许志永是刚刚抓进来的,警方有可能要加大审讯力度,所以要我48小时再来。这显然是违法的。我说恰恰是因为刚刚抓进来,我的当事人才最需要我第一时间见到他。”

许志永的辩护律师刘卫国怀疑许志永遭到刑讯逼供。他对《新唐人》说,当局对许志永任何不合法的行为,他都会提出控告。

不过,北京时间18号下午6点左右,推特上有消息传出,刘卫国律师在等待会见许志永时,被北京大兴公安局民警以“涉嫌聚众扰乱社会秩序”为由,带到孙村派出所。

18号当天,也有3、40名维权人士到北京市第三看守所,为许志永存钱送物,但下午2点左右,警方抓走了马强、李学会、姜流勇、康素萍在内的十多位网友。

据了解,中共当局今年已经利用“煽动颠覆国家政权”、和“聚众扰乱社会秩序”、及“聚众扰乱公共秩序”三个罪名,抓捕了一些人。

中国《维权网》统计,仅北京地区因要求官员公布财产、参与“同城聚餐”而被抓捕的人员已经上升到14人,其中还不包括失踪的,以及各地在北京因同样原因被抓的上访维权人士。

那么,当局这次以许志永“涉嫌聚众扰乱公共场所秩序罪”,把他刑事拘留,许志永是怎样扰乱社会秩序的呢?

知名学者吴祚来在网上留言说,许被软禁了几个月,是警方在非法侵犯人权,却说公民扰乱社会秩序。

北京律师黎雄兵认为,许志永非常正直,是有良知的知识份子代表。

北京律师黎雄兵:“他(许志永)宣导新公民运动,帮助访民、帮助弱势群体,帮助小孩入学,要求教育平等权这些公民行动。”

许志永是北京“公盟谘询有限责任公司”的创始人之一,他也是中国司法史上“三博士上书”事件中,建议全国人大废除“城市流浪乞讨人员收容遣送办法”的提议者之一。他宣导公民以非暴力的方式维护自己的权益。

与此同时,曾曝光重庆淫官的《人民监督网》负责人朱瑞峰,他的微博和网站都在周三被关闭。

北京维权人士胡佳对《新唐人》表示,当局新一轮的严打,使“民间反腐”遭遇了恶梦。胡佳认为,公民要求反腐败、要求签署公民政治权力,这些自发的诉求都是在宪法范围之内的,何罪之有?

北京维权人士胡佳:“因为共产党就是靠谎言、恐怖和暴力统治的,它现在的谎言...现在有人不听它了,它就用暴力镇压一小批人,用恐怖来威慑绝大多数人。”

胡佳表示,中共根本目地就是维护独裁统治,维护几百个家族的特权——那些红二代、红三代的特权,而不惜动用一切,包括谎言和暴力。

胡佳说,中共犯下的人权债根本还不完。但中共暴政把公民的怒火积累到一定的临界点程度,将被引爆而迅速燎原。

China detains activist lawyer Xu Zhiyong, anti-corruption campaign hit iceberg

Xu Zhiyong, civil rights leader and Beijing constitutional
scholar, is well-known for pushing anti-corruption and suggesting government transparency.
After 3 months house arrest, Xu was detained under suspicion
of having "gathered crowds to disrupt public order."
People said that the China Dream has turned into a nightmare.
Let's take a look the report.

At midnight of July 16, Xu Zhiyong was taken
by police from his Beijing home.
The police also confiscated his computers,
mobile phone and other items.

The detention document read, "Xu Zhiyong, arrested
on suspicion of gathered crowds to disrupt public order, now is being held in Beijing No. 3 Detention Center."

Liu Weiguo, Xu Zhiyong's lawyer:
"They don't allow me to see Xu.
They said Xu had just been detained, they want to increase
the intensity of his trial, they told me I can come back in 2 days.
This is clearly illegal.

I said,‘I know Xu just detained,
that's the reason I need to see him before hand.’"

Xu's lawyer, Liu Weiguo, speculates that Xu
was tortured by police in an effort to obtain a confession.
Liu told NTD that he will sue the authorities
for any unlawful act towards Xu.

At 6pm on July 18, news on Twitter read, "while lawyer
Liu Weiguo is waiting to meet Xu,
he is taken away by police on suspicion
of having gathered crowds to disturb social order."
The lawyer was taken to Sun Village detention center."

On the same day, 30-40 activists who went to Beijing No. 3
Detention Center brought money and materials for Xu.
At 2pm, the police detained more than a dozen of them.

Sources said that the authorities arrested some for
"inciting subversion of state power,"
"gathering crowds to disturb social order" and
"gathering crowds to disrupt public order."

A China human rights website data shows that 14 people
had been arrested for private gathering and campaigning to demand officials publicize their property.
The number doesn't include activists who had been arrested
for the same reason in other cities or were forced to go missing.

This time, the authorities arrested Xu on suspicion of
having gathered crowds to disrupt public order."
How can Xu disrupt the social order?

Wu Zuolai, a popular scholar, posted messages online reading
that Xu had been placed under house arrest for several months.
It is the police that break the law
to violate human rights.

Beijing lawyer Li Xiongbing believes that Xu Zhiyong
is very honest, representing conscientious intellectuals.

Li Xiongbing: "He (Xu) supports the new citizen advocacy
campaign, helping petitioners and vulnerable groups.
Xu helps kids to go to school, and requests
equal education rights."

Xu Zhiyong is co-founder of the NGO,
Open Constitution Initiative.
Xu has proposed National People's Congress to abolish
the regulation of detaining beggars or homeless people or sending them back home.
Xu advocates non-violent way
to defend their human rights.

Meanwhile, the microblog and website of Zhu Ruifeng,
who exposed Chongqing official's sex-tapes, was shut down on Wednesday, July 17.

Beijing activist Hu Jia told NTD that the authorities'
new round of suppression has brought a nightmare upon the anti-corruption campaign.
Citizens demanded anti-corruption, and to sign civil
and political rights.
All the demands are within the scope of the law,
what is the crime they are talking about?

Hu Jia: "As the CCP relies on lies, terror and violence,
no one listens to it anymore.
Thus the CCP suppresses the small groups with violence,
to threaten the majority with terror."

Hu Jia said that the CCP's purpose is to keep its dictatorship
and maintain its several hundred families' privilege - the 2nd and 3rd red generations' privilege.
Thus the CCP doesn't hesitate to use any means,
including lies and violence.

Hu Jia said that the CCP's debt for human rights violations
will never be cleared away.
The CCP's cruel dictatorship has pushed the public's anger
to boil over point, which will pour over at any time.
